Terms & Conditions

1. All reservations with Electric Love S.L. are subject to the following conditions: By booking your tour and paying a deposit you confirm that you are over the age of 18 and have read, understood and accept these terms and conditions in their entirety. The customer undertakes to treat the bike/s supplied to him by Electric Love S.L. with due care and to return it according to terms of this contract. Each customer must sign this contract in writing before he / she can book a tour. If the customer does not sign this contract (for whatever reason) and the bike/s where reserved upfront (e.g. online), he / she cannot book a tour and the full price will still have to be paid. This amount will be charged to the customer’s credit card in case of online reservation.

2. The customer is required to check the bike/s for damage and faults at the time he receives it. By using the bike/s, the customer confirms, that he has received it undamaged and with no faults. If a fault or damage appears during use of the bike/s, the customer is required to notify Electric Love S.L. immediately inform to the guide. In the case of damages caused while using the bike/s, the customer is solely liable. In case of damages the customer must pay to Electric Love S.L. the costs of the spare parts and cost of the repairs. In addition he must pay the associated 1 day rate per bike for each day where the bike/s is/are unusable. E.g. because Electric Love S.L. has to wait for spare parts. In the cases described under figures 1 to 2, the customer/s expressly authorizes Electric Love S.L. to charge the compensations directly to his/her credit card.

3. The customer confirms that he and the person he legally represents in the context of the contract with Electric Love S.L. are capable of riding a Mountain Bike. Electric Love S.L. informed the customer that the minimum age for riding e-bike is 16 years old (with parent’s authorization).

4. Riding our bicycles whilst under the influence of alcohol, illegal or toxic substances, or in a manner dangerous to people or property, is strictly prohibited.

5. Taking part on a guided tour is exclusively at the customer’s own risk. Riding on public roads and off-road on many types of track with various gradients always involves some risks. The customer is aware of the risks in relation to his capabilities and takes the risks of his own volition. Instructions from Electric Love S.L. and their staff are to be heeded by the customer as is his responsibility. The customer is solely responsible for adhering to the traffic rules and for his own safety, especially the wearing of protective equipment (bike helmet, adequate shoes etc.). The customer confirms that he is adequately insured for the risks inherent in using a bicycle. He acknowledges that he is not insured by Electric Love S.L. and its employees do not accept any liability – as far as permitted by law – for any damage that the customer causes to himself or third party, or for any damage to the customer by some other cause while using the services of Electric Love S.L., especially whilst riding a bicycle. Furthermore the maximum liability of Electric Love S.L. is limited to the fee paid by the customer.

6. Should one or several of the conditions of this contract be or become ineffective or invalid, or if a loophole is found in the contract, the validity of the other conditions shall not be affected. The invalid or ineffective conditions are to be interpreted or substituted in such a way to correspond most closely to the purpose of the contract. This applies in the case of a loophole in the contract.

7. TOUR ALTERATIONS & CANCELLATION

Electric Love S.L. reserves the right to make route modifications which become necessary due to circumstances beyond their control and undertake to inform participants as soon as possible. Electric Love S.L. reserves the right to cancel the tour in which case all payments including the deposit will be refunded. This will constitute full settlement.

We reserve the right to stop you from participating on your tour if you behave in an abusive and/or threatening manner, or engage in illegal activities.

8. YOUR OBLIGATIONS

You shall: follow the instructions of your Electric Love S.L. professional guide at all times; ensure that you are of an appropriate level of fitness to participate in your tour; notify us of any medical ailments from which you suffer which may affect your ability to participate in the tour; wear a helmet at all times whilst cycling; not cycle when under the influence of alcohol or drugs.

Waiver:

By booking your tour, you: acknowledge that you have been correctly informed about the characteristics of the guided tour; accept that any guidance given by us as regards climate, clothing, special equipment, topography etc. is done so in good faith, but accept that we cannot confirm its accuracy or completeness; acknowledge that it is your responsibility to arrange insurance to cover you during your tour; confirm that you are aware of the physically strenuous nature of our tours and accept the risks and hazards of our tours, including the dangers inherent in cycling either on the road or off the road and any risks that result from (amongst other things) adverse weather conditions and the variable condition of roads and/or tracks; Confirm that you are sufficiently fit and healthy to complete your tour and are aware of no medical reason or condition which would prohibit you from completing your tour; accept the potential for (amongst other things) delays, alterations, loss of or damage to property, inconvenience and discomfort; and accept that you participate in your tour, and cycle, at your own risk.

Insurance:

It is a condition of these terms that you have adequate travel insurance. It is your responsibility to ensure that the insurance fully covers all of your personal requirements including cancellation charges, medical expenses and repatriation in the event of an accident or illness. Your insurance must also cover you for cycling activities and the associated risks as well as your baggage and cycling equipment. If you chose to travel without adequate insurance cover, we will not be liable for any losses arising in respect of which insurance cover would otherwise have been available.

Electric Love S.L. is not liable for personal injury, death, damage to property or other loss whether arising from accident, cancellation, delays or any other matter beyond our control.

9. DATA PROTECTION

We will use the personal information you provide to us to: provide your tour; process your payment for your tour; and inform you about similar products or services that we provide. We will not give your personal data to any other third party. You authorize Electric Love S.L. to use the images obtained in the tour in their online communication channels (Facebook & Instagram).

10. The place of jurisdiction for all disputes with Electric Love S.L. is Puerto Del Rosario. Spanish law is aplicable.
